Terms and Conditions of Use

1. Acceptance and Scope

Accessing, registering for, or using Edunex by any educational institution, administrator, teacher, staff member, student, or legal guardian constitutes full acceptance of these Terms and Conditions and our Privacy Policy.

Edunex is a software platform developed and operated by FRACTAL SOLUCIONES TECNOLOGICAS C.A., Tax ID (RIF) J508147294. If you do not agree to these terms, you must refrain from using the platform or requesting institutional access.

2. Service Description

Edunex provides comprehensive tools for school management, academic records, enrollment, tuition billing, family communication, and assisted payment reconciliation.

Fractal operates as a software platform provider. Except under express custody or settlement agreements, Fractal does not hold school funds: tuition payments and transfers go directly to the receiving accounts authorized by each school.

3. Registration, Accounts, and Credential Security

• All information provided during institutional registration or user activation must be accurate, truthful, and up-to-date.
• Users are solely responsible for maintaining the confidentiality of their credentials and passwords. Actions performed under an authenticated account are presumed authorized by the account owner.
• Schools must configure appropriate roles and permissions for their staff in accordance with their educational duties.
• You must promptly report any unauthorized access or security incident to Fractal support.

4. Institution and User Obligations

• Use the platform solely for educational, administrative, and lawful purposes.
• Do not submit fraudulent information, impersonate others, or alter official records.
• Institutions are responsible for securing proper authorization and consent to manage student, guardian, and staff records.
• The institution and each person providing content declare that they have the authority, necessary rights and permissions to upload it and allow its use in Edunex under these terms, including the rights of its respective owners.
• Reverse engineering, decompiling, or attempting to compromise Edunex infrastructure is strictly prohibited.

5. Subscription Fees, Commissions, and Billing

School use of Edunex is subject to the agreed subscription rates (such as a monthly fee per active student and transaction fees where applicable).

Institutions agree to settle invoices issued by Fractal within the terms established by their subscription tier.

Tuition collection and reconciliation are processed through the payment modality enabled by the institution.

6. Intellectual Property

All intellectual property rights in Edunex, trademarks, code, logos, and user interfaces remain exclusively owned by FRACTAL SOLUCIONES TECNOLOGICAS C.A..

Users and institutions are granted a limited, non-exclusive, non-transferable, and revocable license to access the platform while active.

Content provided by institutions and users remains the property of its respective owners. By providing it with the necessary authority, they grant Fractal non-exclusive, limited permission to host, store, process and display that content solely as necessary to provide Edunex to authorized users of the relevant institution. This permission does not transfer ownership of the content to Fractal.

7. Availability and Limitation of Liability

Fractal strives for continuous availability and security. However, uninterrupted service cannot be guaranteed during scheduled maintenance, external network failures, or force majeure.

Fractal is not liable for academic, disciplinary, or financial decisions made by schools regarding students or guardians.

8. Modifications and Contact

We may update these Terms and Conditions periodically to reflect system updates or legal requirements. The current version will always be published here.
